Does fair conditioned mean it's still working perfectly although have minor scratches and scuffs are keys still good and screen

Yes, Fair condition means, it's 100% functional(ALL devices that we offer are fully functional unless we say so on the title with minor issues) but Fair condition will show signs of use on the body and the screen as well with scratches but not cracked screen.  

Is there a restocking fee on this if I buy it as a present and it's not the right laptop?

Yes. Please be advised that a restocking fee may be charged on all returns that are not defective
